Minutes for the
February 9, 2011 Meeting

        The Zoning Board of Appeals (ZBA) was called to order by Chairman A. Schutte at 7:30 P.M. on Wednesday, February 9, 2011, in the Police Library, Village of Evendale Municipal Building.  Attending were Chairman Al Schutte, members Dave Harwood, Lynn McCarthy, and Mike Reed.  Tom Lippert was absent.  Also present were residents Dave and Kay Bostrom, and Pam Morin, Building Department.

The following request was heard:

        Rest Haven Memorial Park, 10209 Plainfield Road
        A request for two variances:
        1.      From Section 1266.04(a)(1) of the Village of Evendale Zoning Code prohibiting more than two accessory structures;
        2.      From Section 1266.04(a)(6) of the Village of Evendale Zoning Code restricting accessory buildings, except garages, in the Residential District to a maximum areas of 200 square feet.

Representing Rest Haven Memorial Park were Jose Castrejon, Vice President of Landscape Architecture with McGill Smith Punshion, Inc. and Carl Konen, Regional Director of Stonemor, managing company for Rest Haven Memorial Park.  Part of Stonemor’s responsibility is the maintenance of landscaping & existing structures, construction of new structures and selling of lots.

Mr. Castrejon presented the plans for a new 5,678 square foot mausoleum, with a proposed future addition of 1900 square feet.  The location was chosen based on an analysis they had done, which included setback requirements, adjacent burial sites, proximity of utilities, the effects of runoff, and proximity to existing buildings.  The location is east of the maintenance buildings and west of the funeral home.  The mausoleum was designed to match the character of the existing structures and to have minimal impact to neighbors and traffic.  Access to the proposed mausoleum is from the existing Plainfield Road entrance only.   All lighting is interior, no spot lights, to provide minimal lighting for safety.  Parking is limited to two parking spots.

Mr. Castrejon stated that cremation and the use of mausoleums are becoming more popular and Rest Haven Memorial Park wanted to be able to provide both to better serve the community.

Rest Haven Memorial Park appeared before Planning Commission on January 18, 2011 for site and design approval.  Approval was granted with the following conditions:

        1.      The mechanical equipment be screened;
        2.      Four (4) Norway Spruce be added to the buffer;
        3.      That the ZBA approve the mausoleum since it is considered additional accessory structure and ;
        4.      That Council approval the lot split/consolidation.
Mr. Castrejon stated that the plans show the additional Norway Spruces and mechanical screening.  

Mike Reed stated that he recognized that Rest Haven Memorial Park is a 72 acre site and much larger than the average Residential lot, but requesting an almost 6,000 square foot accessory building with the possibility of a future addition of 1,900 square foot, is a considerable increase from the 200 square foot maximum area for accessory buildings in the Residential District.

Members also raised concern that in the future a second access from Glendale-Milford Road to this mausoleum would eventually be built and that granting these variances would increase Rest Haven’s value and income potential, in direct conflict with number six of the required Justifications of Variances.

Dave Harwood made a motion to grant the approval of the two variances as proposed.  There was no second.

Mike Reed made the following motion:  

RESOLVED, that a variance be granted to Rest Haven Memorial  Park allowing construction of the mausoleum in the manner and location set forth on the revised submittal; and

RESOLVED FURTHER, that a variance be granted to Rest Haven Memorial Park allowing construction of the mausoleum in excess of 200 square feet; and

RESOLVED FURTHER, that the following conditions are conditions precedent to approval of the variances:
        1.      Internal access only;
        2.      Size is limited 5678 square foot;
        3.      Fence around the adjacent maintenance buildings be replaced.

This motion was seconded by Dave Harwood.  The motion passed with a vote of 4 yes, 0 no.

Al Schutte made several minor changes to the minutes as read.  Dave Harwood made and Mike Reed seconded the motion to approve the minutes with these changes.  The motion passed with a 4 yes, 0 no vote.

The meeting was adjourned at 8:45 PM
